Terms and free licence

These terms cover using the Train Effect website builder and the website it makes for you, whether you download it free or we put it online for you. If we host your site, the hosting terms apply as well.

Who we are

Train Effect is the trading name of Matthew Paterson, Wellington, New Zealand. You can reach us at matt@traineffect.co.nz.

Using the builder

• The builder is free to use, and you do not need an account.
• Your draft is saved on your device. If you ask for a link, it is also kept on our server for 60 days after you last save it (and no more than six months in all), and anyone with the link can open it, so keep it to yourself.
• Do not use the builder for anything unlawful, or to upload anything you do not have the right to use.

Your content

Everything you put in is yours: your business name, words, photos, logo and the reviews you add. You let us store it, show it in the builder, turn it into your site and, if we host your site, publish it. You promise that:

• you have the right to use every photo and logo you upload;
• anyone whose review you add is happy for it to be on your site;
• what your site says about your business is true, including licences, registrations and memberships.

You are responsible for what your site says.

The design, the code and the pictures

The templates, the code and the library pictures are Train Effect's, and we keep the copyright in them. We give you a free, permanent, non-exclusive licence to use them for your own business's website. That means you may:

• host the site anywhere you like;
• change it;
• keep it online for as long as you want.

You may not:

• sell or give away the templates or the library pictures on their own;
• turn them into a template, theme or picture product;
• use them, or the builder, to make websites for other businesses.

On a site you download free, keep the "Site by Train Effect" line in the footer. If we host your site and you would rather it went, ask us.

The library pictures show the kind of work a trade does. They are not photos of your jobs, so do not present them as your own work.

The fonts are not ours. Each comes with its own licence (the SIL Open Font License), included in the folder you download.

No warranty

The builder and the free download are provided as they are. We do our best to make them work well, but we do not promise they are free of errors or suit every purpose.

Our liability

We are not liable for lost business, lost profits or any indirect loss. Our total liability to you for anything to do with the builder or your site is limited to what you have paid us in the 12 months before the claim, or $100 if you have paid us nothing.

Using this in business

You use the builder for your business. So, as far as the law allows, the Consumer Guarantees Act 1993 does not apply, and nor do sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986. We both agree that is fair.

Changes to these terms

We may update these terms. The date at the top shows when they last changed. The licence you already have for a site you have downloaded does not shrink when we do.

The law that applies

These terms are governed by New Zealand law.
